Terms of Service

These Terms govern access to Cuddles You, a technology marketplace that helps adults discover and communicate with independent providers of lawful, platonic companionship services.

Cuddles You provides marketplace technology. It does not itself provide cuddle sessions, medical care, therapy, transportation, security, or emergency services.

1. Agreement and eligibility

By creating an account, accessing the platform, sending a booking request, posting content, or otherwise using Cuddles You, you agree to these Terms and the policies linked from them. If you do not agree, do not use the platform.

You must be at least 18 years old and legally capable of entering a binding agreement. You must provide accurate account information and keep your credentials secure. You are responsible for activity performed through your account unless you promptly report unauthorized access.

2. Cuddles You is a marketplace, not the service provider

Cuddles You offers tools for profiles, discovery, communication, booking requests, verification workflows, and payments. Providers offer services in their own capacity and are not employees, agents, joint venturers, franchisees, or representatives of Cuddles You.

Cuddles You does not direct or control the manner, location, quality, legality, safety, or outcome of a session. A listing, badge, profile, review, search position, or account status is not an endorsement, warranty, or guarantee. Users decide whether another user and a proposed session are suitable.

Nothing on the platform is medical, psychological, psychiatric, legal, financial, or other professional advice. Cuddle services are not healthcare and must not be used instead of qualified care or emergency assistance.

3. Independent provider responsibilities

  • Providers are solely responsible for the services they describe and perform, including consent, boundaries, pricing, taxes, permits, licenses, insurance, locations, and compliance with applicable law.
  • Providers must ensure that all profile statements, credentials, images, availability, pricing, reviews, and service descriptions are accurate and not misleading.
  • Providers decide whether to accept a request and must refuse or stop any session that is unsafe, unlawful, non-consensual, sexual, coercive, or outside their stated boundaries.
  • Providers may not represent themselves as employees, healthcare professionals, therapists, or agents of Cuddles You unless separately qualified and clearly acting outside the platform relationship.

4. Client responsibilities

  • Clients must review the provider’s profile, pricing, boundaries, cancellation terms, and verification status before booking.
  • Clients must communicate honestly, obtain ongoing consent, respect every boundary immediately, and leave or end a session when requested.
  • Clients are responsible for their own conduct, choice of provider, transportation, meeting location, personal property, and compliance with law.
  • A booking is for platonic companionship only. Sexual requests, coercion, harassment, threats, stalking, discrimination, violence, and illegal activity are prohibited.

5. Bookings, payments, fees, and taxes

A booking request is not confirmed until the provider accepts and both parties complete the applicable connection-fee steps. The quoted session price and each party’s connection fee are locked for that booking when the request is created.

Clients and providers arrange and settle the session price directly with each other after the connection is unlocked. Cuddles You processes only its displayed connection fees and does not receive, hold, transfer, or pay out the session price.

Connection-fee payments may be processed by third-party payment providers under their own terms. Cuddles You may reverse platform credits or request information when reasonably necessary to address fraud, chargebacks, disputes, safety reports, sanctions, or legal obligations.

Providers are responsible for reporting and paying taxes arising from their earnings unless applicable law requires the platform or a payment processor to collect, withhold, or report an amount.

6. Verification and safety limitations

Verification may confirm selected information at a point in time, such as age, identity, email ownership, or submitted documents. It is not a comprehensive background check and does not guarantee identity, history, qualifications, intentions, future conduct, or session safety.

Cuddles You may use manual or automated review, but it has no duty to continuously monitor every user, message, meeting, or off-platform activity. Users must take reasonable precautions and report suspected abuse.

7. User content, messages, profiles, and reviews

You retain ownership of content you submit. You grant Cuddles You a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, display, and distribute that content as necessary to operate, secure, promote, and improve the platform, subject to the Privacy Policy.

You must have all rights and permissions needed for uploaded photos and content. Reviews must reflect genuine experience and may not be fake, purchased, coerced, retaliatory, defamatory, or manipulated. Material connections and incentives must be clearly disclosed.

Cuddles You may investigate, restrict, remove, preserve, or disclose content when reasonably necessary to enforce policies, protect users, respond to legal process, or operate the service. Moderation does not make Cuddles You the author or speaker of user content.

8. Account action and platform changes

Cuddles You may warn, limit, suspend, deactivate, or terminate an account or listing when it reasonably believes there is policy abuse, fraud, safety risk, legal exposure, payment risk, or harm to the platform or another person. Urgent action may occur without advance notice.

Features may change, be interrupted, or be discontinued. Cuddles You does not guarantee uninterrupted availability, a minimum number of leads or bookings, search placement, earnings, or any particular result.

9. Disclaimers

To the maximum extent permitted by law, the platform is provided “as is” and “as available,” without express or implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, safety, or results. Some jurisdictions do not allow certain exclusions, so portions of this section may not apply to you.

10. Limitation of liability

To the maximum extent permitted by law, Cuddles You and its owners, officers, personnel, affiliates, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; lost profits, data, goodwill, or opportunities; or the acts, omissions, content, sessions, injuries, disputes, or property of users or third parties.

To the maximum extent permitted by law, aggregate liability arising from the platform will not exceed the greater of the platform fees you paid to Cuddles You during the 12 months before the event giving rise to the claim or USD $100. This limitation does not apply where liability cannot legally be excluded or limited, including liability arising from applicable non-waivable rights.

11. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Cuddles You and its owners, personnel, affiliates, and service providers from claims, losses, liabilities, judgments, penalties, damages, costs, and reasonable legal fees arising from your content, conduct, services, session, transaction, breach of these Terms, violation of law, or infringement of another person’s rights.

12. Disputes and applicable law

Before filing a claim against Cuddles You, you agree to send a written description of the dispute and requested resolution to the legal contact below and allow 30 days for an informal response, unless urgent relief or applicable law requires otherwise.

These Terms are governed by the laws applicable to the Cuddles You operating entity, without overriding mandatory consumer protections that apply where you live. Venue, arbitration, class-action waiver, and governing-state provisions require the operator’s legal entity and jurisdiction to be finalized in a lawyer-reviewed version before launch.

13. General terms

If a provision is unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions will continue. Failure to enforce a provision is not a waiver. You may not transfer your account or agreement without consent. Cuddles You may assign these Terms as part of a reorganization, financing, merger, acquisition, or sale of assets.

Material updates will be posted with a revised date and, when appropriate, additional notice. Continued use after an update takes effect constitutes acceptance to the extent permitted by law.

Questions, formal notices, and privacy requests should identify your account email and the policy involved. Do not email passwords, full payment-card data, or unnecessary identity documents.
